The trial is typically by jury, but may be decided by a judge (bench trial). If the trial is by jury, there is a jury selection process wherein the jurors are vetted to hear the case. At the beginning of the trial, each party presents an opening statement as to how they intend to prove their case. During the trial, each party presents evidence in the form of exhibits, witnesses, and deposition testimony. At the conclusion of the trial, each party presents a closing statement arguing why the jury should decide in their favor based on the evidence.
