Expert discovery involves reviewing the reports drafted by the Plaintiff's expert technical witnesses and deposing these experts concerning their reports. The Defendant will typically also pay an expert technical witness to draft a report on issues of non-infringement or invalidity, wherein the Plaintiff may depose these experts concerning their reports. The Plaintiff may pay an expert accounting witness on the issue of damages, such as to calculate lost profits and a reasonable royalty.
