Construction Briefs

Both parties file opening claim construction briefs and response construction briefs asserting a desired claim construction for the relevant claim terms. The Defendant will assert a broad interpretation of the claim terms when attempting to invalidate a claim based on prior art, and assert a narrow interpretation of the claim terms when arguing the Defendant's accused products do not infringe a claim. The claim construction is typically the most important aspect of patent litigation since an adverse claim construction typically leads to disposition of the case through summary judgement.
